By accessing or using RecLife ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all users, including visitors, registered members, and business listing owners.
You must be at least 16 years of age to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date. RecLife reserves the right to suspend or terminate accounts that violate these terms.
You agree not to misuse the Platform. This includes, but is not limited to: posting false or misleading trail conditions or safety information; harassing, threatening, or impersonating other users; uploading malicious code or attempting to gain unauthorized access to any part of the Platform; scraping or collecting user data without consent; using the Platform for any illegal activity; posting spam, unsolicited promotions, or commercial content outside of designated business listings.
You retain ownership of all content you create on the Platform, including GPS tracks, photos, reviews, and trail reports. By posting content, you grant RecLife a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the Platform. You may delete your content at any time. You are solely responsible for the accuracy and legality of the content you post.
The RecLife name, logo, and all related branding are the property of RecLife. The Platform software, design, and original content are protected by copyright and other intellectual property laws. Trail data sourced from public agencies and OpenStreetMap contributors is subject to their respective licenses. You may not copy, modify, or distribute any part of the Platform without prior written permission.
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. RecLife does not guarantee the accuracy of trail data, conditions reports, maps, or business listings. Outdoor activities carry inherent risks. You are solely responsible for your safety and for verifying trail conditions, weather, and other hazards before undertaking any activity.
To the fullest extent permitted by law, RecLife and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, personal injury, or property damage, arising from your use of the Platform. Our total liability for any claim related to the Platform shall not exceed the amount you paid to RecLife in the twelve months preceding the claim, or $100, whichever is greater.
You acknowledge that outdoor recreation activities — including but not limited to hiking, mountain biking, trail running, rock climbing, canyoneering, kayaking, whitewater rafting, skiing, fishing, and wild swimming — carry inherent and significant risks. These risks include, but are not limited to: serious bodily injury, paralysis, death, property damage, equipment failure, exposure to weather extremes, encounters with wildlife, falls, collisions with other participants or natural obstacles, and varying or unpredictable trail and water conditions. By using the Platform and participating in any activity discovered, organized, or coordinated through RecLife, you voluntarily assume all risks associated with such activities, whether or not specifically identified herein. You agree that you are solely responsible for assessing your own fitness, skill level, and preparedness for any activity, and for verifying current trail conditions, weather, water levels, and other hazards before participating.
RecLife may facilitate or organize group activities, events, rides, and shuttle transportation ("Organized Activities"). By participating in any Organized Activity, you acknowledge and agree to the following: (a) Mountain biking, trail running, and other group rides involve risks of injury from trail hazards, mechanical failures, rider-to-rider collisions, fatigue, and environmental conditions; (b) Shuttle and transportation services arranged in connection with Organized Activities — whether operated by RecLife, third-party providers, or through participant carpooling — carry additional risks including vehicle accidents, loading and unloading of equipment, road conditions, and driver error; (c) You release and hold harmless RecLife, its officers, employees, volunteers, agents, and affiliates from any and all claims, demands, causes of action, damages, losses, or expenses (including attorneys' fees) arising out of or related to your participation in any Organized Activity, including transportation arranged in connection therewith; (d) This release applies regardless of whether the claim arises from the negligence of RecLife or any other released party, to the fullest extent permitted by law; (e) If you are organizing an event or group ride through the Platform, you are responsible for obtaining any required permits, insurance, and ensuring compliance with local regulations.
Certain activities, events, and group rides on the Platform require you to accept an additional activity-specific waiver before confirming your participation. When you tap "I'm Going," RSVP, or otherwise register for such an activity, you will be presented with a waiver that includes an assumption of risk, release of liability, and indemnification agreement specific to that activity. Your affirmative acceptance (by tapping "I Accept" or checking the acceptance box) constitutes a binding agreement and digital signature. Each acceptance is logged with your user ID, a timestamp, and the waiver version for record-keeping purposes. You may review your waiver acceptances at any time in your account settings. Failure to accept the per-event waiver will prevent your RSVP or registration from being confirmed.
You agree to indemnify, defend, and hold harmless RecLife, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Platform or participation in any activity; (b) your violation of these Terms; (c) your violation of any rights of any third party; (d) any content you submit, post, or transmit through the Platform; or (e) your participation in any Organized Activity, including any injury to yourself or others.
You may delete your account at any time from your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. RecLife may suspend or terminate your access to the Platform at any time for violation of these terms, with or without notice. Provisions that by their nature should survive termination (including limitation of liability, assumption of risk, indemnification, and intellectual property) will remain in effect.
RecLife reserves the right to modify these Terms of Service at any time. We will notify users of material changes by posting a notice on the Platform or by email. Your continued use of the Platform after changes are posted constitutes acceptance of the updated terms. Material changes to the Assumption of Risk or Waiver sections will require re-acceptance. We encourage you to review these terms periodically.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Platform shall be resolved through binding arbitration in Washington County, Utah, or in the courts of competent jurisdiction located in the State of Utah. You consent to the personal jurisdiction of such courts.
